School sex survey lawsuit thrown out

Keep in mind that I am the parent of a 6 year old. I am very biased about this story.

If you want a perfect example of why choosing Federal Judges is an important role of the President, take a look at this: CNN.com – School sex survey lawsuit thrown out – Nov 2, 2005. This is simply an example of the collapse of our society. That a school would survey Elementary School children without parental approval should have never even made it to a civil suit. It may be true that we do not have a law that covers this situation, but we should not have to. The fact that it is not obvious that 6 to 11 year old children should not be talked about sex by anyone without their parent’s clear consent is a sad statement on our society. According to the story

Parents whose students took the survey signed consent forms. But the forms never mentioned sex would be a topic.

That the school would hide the facts of the contents of the survey should be a huge red flag. The real shame in this is that no one at that school is going to jail. I would think that Fraud would be a legitimate charge in this case. If the parents were asked to sign a permission slip that didn’t explain what they were giving permission for, then it is clear that Fraud was committed.

The fact that the 9th Circus Court of Appeals would allow this Fraud to run unchecked should tell you how “Stuck On Stupid” they are.
